Idling Regulations

The American Transportation Research Institute (ATRI) recently published its latest update of state and local idling regulations. For a full list go their website. For locations of interest to trucks that service the New York Metro area, please see below:

 

Location Maximum Idling Time Exemptions
Connecticut 3 minutes

(No limit: Less than 20o F)

Fines: Not > $5,000

*Traffic Conditions or medical difficulties

*Ensure safety or health of driver/passengers

*Conform to manufacturer’s specifications

*Maintenance 

*Queuing to access military installation

New Jersey 3 minutes

(15 minutes if stopped for 3 hours and less than 25o F)

Fines: 

$250 for first violation

$500 for second violation

$1,000 for third and each subsequent violation

*Traffic Conditions

*Mechanical operations

*Waiting or being inspected

*Performing emergency services

*Being repaired or serviced

*Auxiliary power unit/generator set, bunk heaters, etc.

*Sleeper berth with 2007 or newer engine or diesel particulate filter

New York State 5 minutes

(No limit if stopped for 2 hours and less than 25oF)

Fines: $500-$18,000

*Traffic Conditions

*Auxiliary power or maintenance

*Emergency vehicles 

*Within mines or quarries

*State inspections

*Recharging hybrid electric vehicles

*Farm vehicles

*Electric vehicles

New York City 3 minutes

(1 minute if adjacent to a public school)

Fines:

$350 for first violation

$545 for second violation

$740 for third and each subsequent violation

*Emergency vehicles

*Operate loading, unloading, or processing device

Ithaca 5 consecutive minutes

Fines: ≤$250

*Traffic Conditions

*Auxiliary power or maintenance

*Emergency vehicles

Village of Larchmont 3 minutes

Fines: $50

*Temperature of 40oF or less

*Emergency vehicles

*To perform work function

Town of Mamaroneck 5 minutes

Fines: ≤$75

*Traffic conditions

*Auxiliary power or maintenance 

*Emergency vehicles

*State inspections

*Recharging hybrid electric vehicles

*Farm vehicles

*Electric vehicles

*Performing federal, state, or city business 

*Temperature of 40oF or less

Village of Mamaroneck 3 minutes

Fines: $25-$45

*Emergency vehicles

*Perfuming work functions 

New Rochelle 5 minutes

Fines: 

No more than $50 and/or 15 days imprisonment for first offense

No more than $100 and/or 45 days imprisonment for second offense within 18 months

No more than $250 and/or 90 days imprisonment for third and subsequent offenses within 18 months 

*Traffic conditions

*Comply with passenger comfort laws

*Auxiliary power or maintenance

*Emergency vehicles

*Within mines or quarries

*Parked for more than 2 hours & less than 25oF

*State inspections

*Recharging hybrid electric vehicles

*Electric vehicles

*Farm vehicles

Rockland County 3 consecutive minutes

Fines:

No more than $250 and/or 15 days imprisonment for first offense

No more than $1,000 and/or 15 days imprisonment for second and subsequent offenses

*Traffic conditions

*Comply with passenger comfort laws

*To perform work functions

*Maintenance 

*Performing emergency services

City of Sarasota Springs 5 minutes

Fines: ≤$250

*Conditions beyond operator’s control

*Comply with federal, state, or local regulations

*Health of driver or passengers

*To perform work functions

*Emergency vehicles 

Westchester County 3 minutes

Fines: $250-$500

*Traffic conditions

*To perform work functions

*Maintenance

*Recharge hybrid vehicle batteries

*Emergency vehicles

Pennsylvania 5 minutes in any 60-minute period (15 min/hr. if weighing, loading or unloading)

Fines: $150-$300 per offense plus civil penalties up to $1,000

*Traffic conditions

*Prevent safety or health emergencies

*Comply with manufacturer’s specifications

*Emergency or law enforcement purposes

*Maintenance or repair

*Government or security inspections 

*Power work-related operations

*Mechanical difficulties

*Certified clean idle label 

Philadelphia  2 minutes or 0 minutes for layovers (5 minutes if less than 32oF and 20 minutes if less than 20oF)

Fines: $300

None
